SUNDANCE VACATIONS DEFIES THE FTC

In case after case of sales organizations that used the sweepstakes ruse as a means of skirting the Do-Not-Call regulations the FTC has taken remedial action and have repeatedly ruled that sweepstakes entry forms, not-with-standing the alleged fine print disclosures, do not waive the consumers’ privacy rights under the DNC legislation. Yet Sundance Vacations continues to defy the DNC regulations! What does that say about the ethics and integrity of the company? What it says is that Sundance Vacations doesn’t care about what may be illegal or unethical; rather all they care about is what they can get away with and the hell with consumers' privacy rights!

If you have received uninvited and/or unwanted telemarketing calls, as the result of submitting a sweepstakes entry form, you should file an on-line complaint at the FTC's website below:
Sundance Vacations takes the position that their sweepstakes are real because they award the grand prize on a perennial basis. They also boast of all the self-generated and self-promoting awards that the company has received, but those defenses are smokescreens! The fact remains that a sweepstakes entry form does NOT constitute express written permission authorizing incessant telemarketing calls; plain and simple!

In each of the aforementioned cases, the pivotal issue considered by the FTC was consumer intent. Did the consumer submit the sweepstakes entry form with the hopes of winning a prize; or, did the consumer submit the sweepstakes entry form with the knowing intent of authorizing and/or requesting incessant telemarketing calls. It doesn't take a rocket scientist to recognize the obvious answer! Sundance can telemarket those who enter the sweepstakes, but NOT if that individuals' phone number is on the DNC list; why else would they be on the DNC list other than to avoid incessant telemarketing calls; duh!
